The Senate confirmed James Danly as a commissioner of the Federal Energy Regulatory Commission (FERC) in a 52-40 vote, reports The Hill. Danly is President Trump’s pick for a Republican seat on the commission that regulates the interstate transmission of electricity, natural gas and oil.

In a break from tradition, a Democrat was not nominated alongside Danly to fill a vacant Democratic seat on the board, according to The Hill.

The Hill reports that others in Washington have criticized the nomination itself, calling into question Danly’s character. Senate Minority Leader Charles Schumer (D-N.Y.) says that Danly may have given bad ethics advice to FERC commissioners in the past, while saying that he “lacks the experience of past nominees and it seems his major qualification is… deep ties to the energy industry.”
